TERMS OF ENGAGEMENT

*Please Note: Our fees are only indicative at this stage and can change after the initial site consultation, depending on the complexity or if additional scope is requested.

For services where we have stated TBA (To be announced) or TBC (To be confirmed), this is because at this stage we cannot ascertain the full extent of the planning approved scope. These fees are to be agreed following the successful planning approval. Indicative costs are available upon request.

  1. The following terms and conditions set out the basic contractual agreement between the client & DeVis Architecture Ltd.
  2. DeVis Architecture Ltd commits to delivering the services outlined in this fee proposal at the agreed-upon rates (unless otherwise indicated).
  3. This fee proposal shall remain valid for the period of 20-working days, after which DeVis Architecture Ltd reserves the right to adjust the fees.
  4. All dimensions specified in the provided drawings must be verified on-site by the site representative and/or main contractor. Any disparities should be promptly reported to DeVis Architecture Ltd for resolution.
  5. Planning application drawings are not construction issue drawings. All measurements & site conditions should be verified prior to works commencing on-site.
  6. DeVis Architecture Ltd operates as a non-VAT registered entity. Unless stated otherwise, our fee schedule does not include VAT.
  7. This fee proposal excludes expenses incurred by third parties, such as planning application fees and fees for external consultants. The client is responsible for directly covering all council submission fees and external consultant expenses.
  8. If in any case the scope of works changes, DeVis Architecture Ltd reserves the right to adjust the fee proposal accordingly.
  9. The planning process typically does not necessitate extensive council liaison or negotiation. However, in exceptional circumstances, additional fees may be applied at DeVis Architecture Ltd’s discretion.
  10. Additional services requested will be subject to discussion and agreement on hourly rates or additional fees before commencement. Where additional hours are agreed upon, they will be chargeable at the standard rate of ÂŁ100 p/h.
  11. The fees quoted in this proposal are fixed unless otherwise agreed upon. Any proposed changes will require prior approval from the client.
  12. DeVis Architecture Ltd retains the right to engage third-party consultants. The client will be duly informed prior to their appointment.
  13. Upon request, DWGs/raw files can be provided. By accepting these files, the client agrees to release DeVis Architecture Ltd from liability for any discrepancies therein.
  14. DeVis Architecture Ltd does not guarantee specific outcomes for applications and will not be held liable for costs associated with refusal, as planning permission is subject to the discretion of the Local Planning Authority.
  15. DeVis Architecture Ltd will not cover the costs of reports requested by the council beyond those included in the original fee proposal.
  16. The client acknowledges that project timelines may be affected by factors beyond the control of DeVis Architecture Ltd, such as planning authority processing times.
  17. DeVis Architecture Ltd reserves the right to terminate services in the event of non-payment or breach of contract by the client.
  18. Either party reserves the right to unilaterally cancel the project. Upon cancellation, charges will apply solely for work completed up to that point. Charges will be calculated proportionally based on the stage of work completed up to the time of cancellation or termination.

FEE EXCLUSIONS

*Please Note: DeVis Architecture Ltd does not advertise itself as a Chartered Practice. As such, our services are limited to our skillset and do not cover services which legally require sign-off from associated professionals. Exclusions to our services can be found below:

  1. Structural Engineering: We do not provide structural engineering services. However, we can recommend suitable contractors for this aspect of the project.
  2. Bespoke Detail Drawings: We do not provide bespoke construction detail drawings. For complex proposals, we advise to consult with a suitable professional (e.g. glazing suppliers, certified structural engineer).
  3. Building Control: We do not provide building control services, as this is a regulated profession bound by strict conflict of interest regulations. However, when required we will recommend an approved inspector to be appointed.
  4. Party Wall Services: We would be happy to recommend a party wall surveyor if required.
  5. Legal Advice: We do not offer legal advice related to property laws, contracts, or any other legal matters. Clients are encouraged to seek legal counsel if needed.
  6. Contract Administration & Project Management: We do not currently provide project management services. Clients may opt to engage a project manager separately to oversee the execution of the project.
  7. Land Surveying: Our services do not encompass land surveying. Clients may need to engage a qualified land surveyor separately for this aspect of the project.
  8. Construction: We do not undertake construction activities. Clients will need to engage a licensed contractor for the construction phase of the project. We can recommend reputable contractors upon request, though advise on conducting your own research also.
  9. Financial Consulting: Whilst we do provide outline budget estimates, we do not provide professional financial advice or assistance with budgeting. Clients are advised to consult with financial professionals for matters related to project financing and budget management.
